Terms & Conditions

These Terms and Conditions are referred to in the Sales Invoice and will form part of the sales contract.

1.      Introduction

1.1.    These are the ‘Terms and Conditions’ on which Catherine Budd Jewellery (referred to in these terms as ‘I’ and ‘me’) will conduct business and supply products to you.

1.2.    You can contact me by emailing info@catherinebuddjewellery.co.uk or by calling +44 (0) 7701 080 615. If I need to contact you, I will do so by using the details provided by you. 

1.3.    When I use the words ‘writing’ or ‘write’ in these terms, this also includes emails and other forms of phone messaging such as WhatsApp.

1.4.    A ‘Bespoke Product’ refers to my original fully bespoke pieces, customised pieces, and pieces where the product is manufactured especially for you.

2.      My contract with you

2.1.    These terms and conditions will be published on my website, and will be referred to in the sales invoice.

2.2.    The contract will be between you and me to provide a finished piece of jewellery as per the agreed design illustration, in accordance with these terms and conditions, and the terms of the sales invoice issued.

2.3.    My acceptance of your order will not take place until a non-refundable deposit of 50% (or otherwise stated) is received in full, at which point a contract will come into existence between you and me and it will be deemed that you have accepted these terms and conditions.

3.      Your rights to end the contract

3.1.    The consumer right to cancel a contract under the Consumer Contracts Regulations 2013 do not apply to Bespoke Products. If for any reason you wish to cancel an order for a Bespoke Product you should contact me immediately. Please note that the 50% deposit (or amount otherwise agreed) is non-refundable. In some circumstances I may be able to cancel your order and charge a reduced price, but this will not be appropriate in all circumstances and you may still be charged the full price.

4.      My rights to end the contract

4.1.    If I am unable to accept your order, for any reason, I will inform you of this immediately.

4.2.    If once the contract comes into existence, I am unable to contact you despite my reasonable efforts for a period of 15 working days, I may end the contract and paragraph 4.3 will apply.

4.3.    If I end the contract in the situations set out in paragraph 4.2 please note that the 50% deposit (or amount otherwise agreed) will be non-refundable and you may still be charged the full product price. In addition, I may charge you reasonable compensation for the net costs I will incur as a result of you breaking the contract. 

5.      Design and manufacture

5.1.    During the consultation, drawing and notes of your requested design and specifications will be made. I will not start work on the manufacture of your order until you have confirmed to me in writing that you are happy with the design and design specification, which will have been confirmed to you in writing.

5.2.    I pride myself on the accuracy of my 2D and 3D designs when compared to the finished product, however, because each of my Bespoke Products are one of a kind and hand finished, there may be some very slight variations between the approved design and the finished product. Such variations do not constitute faults in the final product.

6.       Changes to design

6.1.    I am happy to discuss alterations to the design at any stage during the process, and will do my best to accommodate this, however once the final design has been agreed by you and the manufacturing has commenced, it may not be possible to make any alterations or changes. 

6.2.    Depending on the extent of the alterations, additional charges may be incurred, which will be notified to you in writing. This would be applicable where significant alterations are made, or where the alterations to the design involve additional work or require different materials. These charges may either require payment in full before proceeding with the design, or they may be added to the remaining balance payment.

7.      Completion dates 

7.1.    Where you have ordered a Bespoke Product, an estimated completion date will be notified to you and will usually be approximately eight weeks from the date on which I accept your order.

7.2.    Whilst I will do my absolute best to accommodate completion dates, it is important to understand that my jewellery is never compromised or rushed and as such the completion date is an estimation only.

8.      Collection and delivery

8.1.    Collection of jewellery will be by appointment during my working hours, excluding weekends and public holidays, unless otherwise agreed. 

8.2.    Collection and payment for the finished product must be no more than 5 days after notification that your order is ready to collect. If this timeframe is not possible and will be longer than 5 days, the balance payment will still be required within the 5 day period and a collection date will be agreed.

8.3.    If the finished product is not collected in person, delivery can be arranged, typically via Royal Mail Special Delivery. The balance payment will still be required within the 5 day period. 

8.4.    If you do not collect the finished product from me as arranged or make arrangements for delivery and if, despite reasonable efforts, I am unable to contact you or re-arrange collection or delivery, I may end the contract and paragraph 4.3 will apply.

9.      Price and payment

9.1.    The price of the product (which includes VAT) will be as set out on the sales invoice. By placing your order, you agree to the payment terms stated in the sales invoice.

9.2.    Any quotation or invoice shall only be valid for a period of fifteen business days.

9.3.    A non-refundable deposit of 50% (or otherwise stated) of the total invoice is required when placing your order and before commencement of any CAD design and/or manufacturing.

9.4.    Unless agreed otherwise, you will be required to pay the balance of the product(s) in full before collection or delivery can be made. This includes full payment for any additional charges due to changes you have requested after having approved the final design (see paragraph 6).

9.5.    Balance payments for Bespoke Products must be made within 5 days of an invoice being issued and can be made via cash, or bank transfer. Please note that you will be responsible for any payments made by bank transfer that incur any additional charges. 

9.6.    Once I have received payment in full, transfer of ownership will occur and the product(s) will become your responsibility from the time you collect it from me, or it is delivered to you. Upon transfer of ownership, insurance and protection becomes your sole responsibility. 

10.   Returns and refunds

10.1.    Bespoke Products will be made or customised especially for you; because of this, no refunds will be given on any bespoke or customised piece of jewellery at any time, unless the finished product is deemed to be mis-described, faulty or defective.

11.   Marketing and intellectual property

11.1.    The payment you make for a Bespoke Product from me is for the finished product only. All intellectual property rights in the design of your piece, in any of the drawings or images produced or the finished product shall be owned by me.

11.2.    I have full right to use photos and/or videos of the product(s) on my website, social media profiles, and any other marketing material for the purposes of promoting my business.

11.3.    It is your responsibility to ensure that you have all necessary ownership rights in any materials provided to me or any requested designs.

11.4.    This section (11) shall survive termination of the terms and conditions.

12.   Your personal information

12.1.    I will use the personal information you provide to me:

12.1.1.  to supply the products and associated paperwork to you;

12.1.2.  to give you information about similar products that I provide, typically emailed newsletter, but you may stop receiving this at any time by contacting me.

13.   Sizing 

13.1.    Clients are offered a complimentary resize of 2 sizes smaller or larger than original size up to 30 days after they have collected their ring. After 30 days, rings will be assessed for the cost of resize. 

13.2.    If the resize range is outside the permitted range, or the design of the ring does not allow for resizing, the ring may need to be remade entirely, and such cost will need to be paid by you.

14.   Client’s stones or jewellery 

14.1.    Great care and responsibility is taken for any stones or jewellery belonging to a client whilst in my guardianship, however it is important that these item(s) are adequately insured under your own personal insurance policy and that any risk to the item whilst in my care, is accepted by you and that I ultimately hold no responsibility for these items. 

14.2.    Specifically, for stone set pieces, due to the fact the history of the stone or jewellery is often unknown I cannot guarantee how sound it is and there for will not be held responsible for any damage or breakage incurred whilst it is in my possession. Please be advised that if any damage or breakage is found upon un-setting the stone(s), or imperfections that may cause risk of damage, you will be informed immediately.

15.   Warranty 

15.1.    Bespoke Products are accompanied by a 1 year warranty from the date of purchase against any manufacturing defect. Please note that the warranty does not cover any damage to, or loss of diamonds or gemstones. 

15.2.    The warranty does not cover damage caused by wear and tear, accidental damage, or loss or theft, and any work, repair or modification of your jewellery not conducted by Catherine Budd Jewellery will void the warranty.

16.   Force Majeure

16.1.    I shall not be under any liability of any kind for non-performance in whole or in part of my obligations under the contract due to causes beyond the reasonable control of the Company or of the Companies suppliers.

17.   Further information

17.1.    By proceeding with the commission, you confirm that you accept the terms and conditions and that you agree to comply with them. If you do not agree to these terms, you must not proceed with the commission. I recommend that you keep a copy for future reference.

17.2.    Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
